The Office of the President of Ukraine is preparing to decide on the legitimacy of Volodymyr Zelenskyy’s presidential powers as his term comes to an end.
According to ZN.UA, the President’s Office has prepared a text of an appeal to the Constitutional Court, which addresses key issues related to Zelenskyy’s legitimacy after May 20. According to the Constitution of Ukraine, the term of office of the president expires on May 20, 2024, which leads to the need to hold regular presidential elections. However, the possibility of voting under martial law is questionable.
However, the President’s Office is considering various options to overcome this situation, including an appeal to the Constitutional Court to interpret the provisions of the Constitution governing elections and the five-year term of office. One of the key issues raised before the Constitutional Court is the possibility of holding elections in a time of war.
The Constitutional Court’s decision on this issue will determine whether voting is allowed under the Constitution during martial law. The Electoral Code and the law on martial law should regulate this. The second aspect concerns the legitimacy of the president’s powers after the expiration of the five-year term.
It is noted that the Constitutional Court has not yet received a relevant submission from the President’s Office. As of February 27, the President’s Office has not yet decided on the constitutional appeal, ZN.UA reports. If this is done, MPs from the Servant of the People party plan to file a constitutional appeal with the Constitutional Court.
